1. Definitions
1.1 'Seller' means Crosby Blinds, retail shop at 103 Liverpool Road, Crosby, Liverpool L23 5TD and not www.crosbyblinds.co.uk & www.blindshouse.co.uk e-commerce websites, which have their own set of terms and conditions
1.2 'Buyer' means the person or company who buys the goods or invites the seller to supply goods or services.
2. Applicability of Conditions
2.1 Any contract shall consist of the Buyer's order in most cases verbal. Or their invitation to provide goods or a service. This shall be deemed conclusive of the Buyer's acceptance of these conditions.
2.2 Any order accepted by the Seller shall be subject to these conditions of sale and no other conditions shall apply unless expressly agreed in writing by the Seller.

3. Cancellation or Amendment of Order by the Buyer
3.1 You may only cancel your order within 24 hours of giving the order or verbal order.
3.2 Every blind is custom made to your precise requirements, once made, our products are suitable only to you, and therefore cannot be resold. Because of this it is extremely important that you are sure about the product that you want.
3.3 If a order has multiple blinds, the total order cannot be refused or returned, if only part of the order is incorrect or delayed
3.4 Goods produced and ready for installation or delivery, but refused by the buyer for what ever reason will be deemed as ‘payment due’ goods will be stored by the seller for a maximum of 30 days only.
4. Terms of Payment
4.1 Full payment is due on or before day of installation.
4.2 Payment unless otherwise stated by the Seller shall be payable by the Buyer in advance at time of order for supply only goods or goods the seller did not measure/survey.
4.3 The Seller reserves the right to charge interest on all overdue invoices at 3% above the Bank of England base rate. Such interest being deemed to accrue on a day-to-day basis from the date payment becomes due.
4.4 We do not offer any form of credit, so orders placed are bound to the sellers terms of payments not the buyers internal payment policies
4.5 Payment by credit or debit card is +2% surcharge.
5. Retention of Title
5.1 Goods produced and ready for installation or delivery, but refused by the buyer for what ever reason will be deemed as ‘payment due’ and retention of title transferred to the buyer. Goods will be stored by the seller for a maximum of 30 days only.
5.2 Legal and beneficial ownership of the Goods shall remain with the buyer until such time as we have received cleared payment in full of all sums due to us.
6. Fitness for Purpose
6.1 While great care is taken in making your blinds to the size requested all made to measure blinds & awnings are produced with a operating/manufactures tolerance of +/-5mm
This is industry standard.
7. Liability
7.1 The Seller shall be under no liability what so ever to the Buyer for any indirect or consequential loss, or expense (including loss of profit) suffered by the Buyer arising from a delay or order error.
8. Return of Goods
8.1 Every blind is custom made to your precise requirements, once made, our products are suitable only to you, and therefore cannot be resold or returned.
8.2 Any blinds supplied incorrect i.e the wrong colour or size, will be replaced or repaired by the seller, it is no ground what so ever to cancel the order
8.3 The Seller, only, can decide if a blind should be repaired or replaced.
9. Damaged / Faulty Goods/Warranties
9.1 All goods are covered by a manufactures (not the sellers) minimum 12 month warranty.
9.2 During the 1st 6 months only, the seller will either repair or collect and then return to the manufacture any faulty goods, then reinstall them at the sellers cost.
9.3 From 6-12 months after installation the seller will either repair or return any faulty goods to the manufacture at the sellers cost, but the goods must be returned to the seller and collected from the seller at the buyers cost.
9.4 After 12 months any requests to repair faulty items will incur a £20 call out charge, plus a parts and labour charge which will be quoted by the seller on inspection
9.5 The Seller, only, can decide if a blind should be repaired or replaced.
10. Product Documentation
10.1 Whilst the Seller takes every precaution in the preparation of, its collection books, technical information, price lists and other selling aids, these documents are for the Buyer' general guidance only. The seller reserves the right to change specifications at any time. 11.1 Any dates, times or periods for delivery and installation of Goods quoted by us are estimates only and we shall not be liable for failure to meet such estimates or for any costs charges or expenses incurred as a result of any delay. The Buyer will not be entitled to refuse to accept the Goods or to cancel the contract with the Seller merely due to such failure. 11.2 The Seller reserves the right to deliver the Goods by instalments and in such event such instalments shall be treated as a separate contract provided that deliveries of further instalments may be withheld until the Goods comprised in earlier instalments have been paid for in full.
10.2 All Sizes are displayed and ordered as width x drop in that order.
11. Delivery & Installation
11.3 Deliveries and installations are made Monday-Friday. 9.00-4.00pm
11.4 A failed delivery or installation (when the customer does not keep the given appointment without notice) a re-call charge of £15 will apply, to cover fuel and lost admin etc.
12.1 All disputes arising out of or in connection with this contract shall be governed by English Law
